Real estate/buildings: Operating permit
Structures for which a building permit is required, except non-complex structures, may only be used after they have been issued an operating permit.
When the construction is completed, an operating permit must be obtained. An operating permit for a complex structure or a structure with an impact on the environment is issued in a special fact-finding procedure based on a technical inspection.
For other structures, operating permits are issued without a special fact-finding procedure and technical inspection, based on the documents submitted and the statements issued by certified experts. One of the conditions for granting an operating permit is a complete operating permit application.
Investors can request that a technical inspection be carried out in the procedure for granting an operating permit.
For single-dwelling buildings, a statement by the supervisor and the head of supervision that the works have been completed in accordance with the building permit issued and the detailed construction design document and that the building complies with the essential requirements is enclosed with the application instead of a document certifying the reliability of the building.
Investors may apply for an operating permit for a single-dwelling building even if the building's envelope has not yet been completed. Instead of a document certifying the reliability of the building, an adjusted statement by the supervisor and the head of supervision is enclosed with the operating permit application. The investor must complete the building's envelope within three years of the issue of the operating permit.
If it is not possible to submit a document certifying the reliability of a structure due to the death of participants in the construction, the age of the structure, the winding up of the business, bankruptcy or other circumstances, a statement by the building designer, supervisor or investor and their certified expert is used as proof of compliance with the essential requirements.
If the regulations governing environmental protection provide that initial measurements and operational monitoring must be carried out, a trial operation is ordered for the structure for the period determined in the programme of initial measurements before an operating permit can be granted for the structure. A trial operation must be notified by the investor.
The building designer, the supervisor and the investor bear criminal and disciplinary liability for the veracity of their statements.
If an operating permit is required for a building, this permit is also a condition for house number allocation.
