ApplicationOperating permit application
An operating permit application is submitted to the administrative body that issued the building permit.
Instructions
The investor or their authorised representative electronically signs a completed application and submits it to the competent authority. Electronic applications are submitted via email. The limit for email attachments is 8 MB.
Send the completed application to:
- the Administrative Unit in whose territory the structure is located,
- the Ministry of Natural Resources and Spatial Planning for structures of national importance (as laid down in paragraph four of Article 9 of the Construction Act) and for structures with an impact on the environment (as laid down in the Decree on activities affecting the environment that require an environmental impact assessment)
If the application is not free of costs, the administrative unit will ask you to pay for the application.

To submit the application you need
- a completed (prescribed) application form for an operating permit – Annex 14;
- land data (filled out within the application) – Annex 4C;
- as-built documentation (PID) with indicated deviations from the documents required for a building permit (DGD) and the detailed construction design document (PZI);
- the opinion of the competent opinion-provider regarding the compliance of admissible minor deviations with the issued opinion, if the deviations concern the opinions previously issued by this opinion-provider;
- a document certifying the reliability of the structure (DZO);
- proof of submission of application for the registration of the structure in the Real Estate Cadastre or the Cadastre of Public Infrastructure, if so required by a regulation;
- if compensatory measures were imposed in the building permit: a description of their implementation and the opinion of the organisation responsible for nature conservation on the performance of the measures;
- for a structure with an impact on the environment: the programme of initial measurements;
- for a nuclear or radiation facility: the assent of the authority responsible for nuclear safety to the start of trial operation, as laid down in the regulation governing protection against ionising radiation and nuclear safety.
When the subject of the operating permit is change of use (instead of a document certifying the reliability of the structure (DZO)):
- a statement by the supervisor and the head of supervision for operating permit application for the change of use – Annex 15A.
For single-dwelling buildings (instead of a document certifying the reliability of the structure (DZO)):
- a statement by the supervisor and the head of supervision for an operating permit application for a single-dwelling building – Annex 15B;
- a statement by the supervisor and the head of supervision for an operating permit application for a single-dwelling building without a complete envelope – Annex 15C.
When a document certifying the reliability of the structure (DZO) cannot be obtained due to special circumstances:
- a statement by the building designer, supervisor or contractor that in special circumstances replaces the document certifying the reliability of the structure (DZO) – Annex 15D.
For a structure built without a building permit in accordance with paragraph two of Article 1 of the Construction Act or for urgent reconstruction referred to in paragraph three of Article 5 of the Construction Act:
- as-built documentation (PID) with a statement by the building designer and the head of project design documentation for a structure built without a building permit – Annex 2G;
- environmental protection or nature conservation approval.

Instructions
Send a completed application by registered mail to the administrative body that issued the building permit or to the Ministry of Natural Resources and Spatial Planning for structures of national importance (as provided by paragraph four of Article 9 of the Construction Act) and for structures with an impact on the environment (as provided by the Decree on activities affecting the environment that require an environmental impact assessment).
The costs of an operating permit comprise the administrative charge and the costs of technical inspection.
Young families resolving their housing needs are exempt from the administrative charge. Young family is a family with at least one child in which neither of the parents is older than 30 years, regardless of the age of children, or 35 years if children are below school age. Age is considered the age reached in the year in which the family submits the application. Any family form other than a domestic community of two parents and children is also considered a young family.
The costs of technical inspection:
- the reimbursement of the costs incurred by the members of the technical inspection commission related to the inspection (travel expenses, daily allowance),
- remuneration for the expert work performed by the experts appointed to the technical inspection commission.
